Application for a Place of Entertainment Permit (indoor), Place of Entertainment Permit (outdoor), Extended Hours Premises, Limited Live Performance (indoor), Limited Live Performance (outdoor), Fixed Place Amplified Sound (outdoor)

We can also prepare the outreach mailing for an extra fee. The Entertainment Commission will approve the letter first that the place of business will draft. We can then mail out your approved letter and a copy of the Good Neighbor Policy (GNP). You will need to do outreach to your neighbors as discussed at your in-take meeting and post our yellow public notice at your location for 30 days. Express Mapping can take care of your outreach to your neighbors. The mailing of the letter is a separate fee. We will provide the quote for the mailing with the completion of your work. If you prefer to get a quote for everything all at once, please contact us and we can research the total for the data and mailing for your location.

You need a Place of Entertainment (POE) permit if you:

  • Have entertainment at your business on an ongoing basis
  • Entertainment is a primary use for the business, like a live music venue, nightclub, concert hall, or special event venue
  • Have customers or members
  • Have indoor live performances until 2 am

Your entertainment can be indoor or outdoor.

If you only want to have entertainment until 10 or 11 pm and entertainment is a secondary use of your business, you can apply for a Limited Live Performance (LLP) Permit.

Entertainment includes any of the following:

  • Musician
  • Band
  • DJ
  • Theater performance
  • Dance performance
  • Comedy show
  • Drag show
  • Karaoke
  • Fashion show
  • Poetry reading

You don’t need an entertainment permit if you have:

  • Indoor pre-recorded music that doesn’t involve a live performer, like a song playlist or a jukebox
  • An unamplified solo performer that’s performing indoors at a business before 10pm
  • Indoor trivia
  • Indoor magic shows
  • Indoor music lessons

Glossary:

Place of Entertainment (POE) permit - Permits live performances until 2:00 am including DJs and karaoke

Limited Live Performance (LLP) permit Accessory use permit – for spaces where entertainment is not the primary use (ex: café), entertainment must end by 10 or 11pm depending on zoning district

Extended Hours Premises (EHP) permit Permits entertainment or food service after 2 am

Fixed Place Amplified Sound (FPAS) - permit Accessory use permit – allows a business to use amplified sound equipment outdoors

 

Entertainment, General. A Retail Entertainment, Arts and Recreation Use that provides entertainment or leisure pursuits to the general public including dramatic and musical performances where alcohol is not served during performances, arcades that provide eleven or more amusement game devices (such as video games, pinball machines, or other such similar mechanical and electronic amusement devices), billiard halls, bowling alleys, skating rinks, and mini-golf, when conducted within a completely enclosed building, and which is adequately soundproofed or insulated so as to confine incidental noise to the premises. Mechanical amusement devices are further regulated in Sections 1036 through 1036.24 of the Police Code.

Entertainment, Nighttime. A Retail Entertainment, Arts and Recreation Use that includes dance halls, discotheques, nightclubs, private clubs, and other similar evening-oriented entertainment activities which require dance hall keeper police permits or Place of Entertainment police permits, as defined in Section 1060 of the Police Code, which are not limited to non-amplified live entertainment, including Restaurants and Bars which present such activities, but shall not include any Arts Activity, any theater performance space which does not serve alcoholic beverages during performances, or any temporary uses permitted pursuant to Sections 205 through 205.4 of this Code. This use is also subject to the controls in Section 202.11.


Fixed Place Outdoor Amplified Sound Locale. A Business that uses Amplified Sound Equipment, not attached to a Sound Truck, at any location out of doors in the City for more than a total of 12 days, whether consecutive or non-consecutive, per 12-month period, and at which Entertainment is not furnished or does not occur; for example, playing recorded
music on Any Sidewalk Abutting the Premises, patio, courtyard, plaza, or other outdoor space that is under the control of the Business or for which the Business has obtained a permit to use from the City. This definition shall not include property that is a Private Residence.
