4.24.070 Removal of city trees as initiated by abutting property owner

Any property owner desiring to remove a city tree abutting his or her property shall submit an application, along with any required fees, to the director requesting such removal to be undertaken by the city. The application shall be on a form approved by the director and shall be accompanied by a written statement setting forth the reasons for the request and any supporting evidence.

Upon receipt of an application and the required fees, the director shall schedule a public hearing before the commission.

Notice of the public hearing shall be provided in writing to the property owner of each property on the street block at least ten days prior to the public hearing. The notice shall state the date and time of the public hearing and a brief description of the action. Notice shall be by first-class U.S. mail.
PUBLIC HEARING
Mailing of the notice at least ten days prior to the hearing to the applicant, to the owner of the property subject to the development agreement, to each local agency expected to provide fire, police, water, sewage, streets, roads, schools, or other essential facilities or services to the project whose ability to provide those facilities and services may be significantly affected, to any person who has filed a written request for notice with either the city clerk, and to all persons shown on the last equalized assessment roll as owning real property within 300 feet of the property which is the subject of the proposed development agreement; provided, the director may direct that notice be given over a wider area to adequately inform interested persons. If the number of owners to whom notice is to be mailed is greater than 1,000, the director may as an alternative provide notice in the manner set forth in Section 65091 of the California Government Code, which includes posting a public hearing notice at the subject property and publishing a public hearing notice in a newspaper of general circulation in the city of La Cañada Flintridge.

 

WIRELESS:

Notice; Decisions. The provisions in this section describe the procedures for the approval process, any required notice and public hearings for a WTFP application.

Administrative WTFP Applications. Notice of a WTFP application for an SWF shall be mailed to owners and occupants of real property surrounding the proposed SWF site in the manner specified in the SWF Regulations. Applications qualifying for eligible facilities requests shall not require notice.

Major WTFP Applications. Any Major WTFP application shall require notice and a public hearing. Notice of such hearing shall be provided in accordance with Government Code Section 65091. Public notices shall include color photo simulations from three different angles depicting the wireless telecommunication facility as proposed to be considered by the Public Works and Traffic Commission. If the application proposes the use of an existing or replacement eligible support structure, such simulations shall be posted upon the proposed support structure for a period of at least 30 days prior to the date of approval; such posted simulations shall remain in-place until final decision on the application is reached.

i. The project applicant and property owner,
ii.  Any person who submitted written comments concerning the WTFP,
iii. Any person who has filed a written request with the city to receive such notice, and
iv.  Any homeowner association on file with the city that has jurisdiction over the WTFP site.
